The European Commission’s designation of ChatGPT as a Very Large Online Search Engine, alongside Reddit and Roblox as Very Large Online Platforms, has opened a four-month compliance countdown under the Digital Services Act that will run to late December 2026. The decision, announced on August 31, places three markedly different digital services under the EU’s most demanding platform-scrutiny framework. For OpenAI, the central question is how rules designed around search and systemic information risks apply to a generative AI product whose search functions may be intertwined with conversational answers.
For Reddit, the challenge concerns a large discussion platform built around user communities and moderation systems. For Roblox, it sharpens long-running questions about safety, discovery and protections for minors in virtual environments. The designations are not penalties in themselves.
They begin a compressed transition period in which the companies will be expected to demonstrate that their systems can identify and mitigate the systemic risks associated with services operating at very large scale in the European Union.
A test of the DSA beyond conventional platforms
The significance of the Commission’s move lies partly in the range of services involved. The DSA was written to impose heightened duties on the biggest online intermediaries, but ChatGPT, Reddit and Roblox do not fit neatly into one shared model of platform governance. Reddit’s service depends on user-created communities, posts and voting systems.
Roblox combines social interaction, user-generated experiences and virtual-world design, with a particularly consequential relationship to younger users. ChatGPT presents a different regulatory boundary: a generative AI interface that can produce responses, potentially incorporate search functionality and shape how users discover and interpret information. That difference makes a uniform compliance approach unlikely.
The Commission’s designation framework may place the companies in comparable legal categories, but the risks to be assessed and the mitigations required will depend on their products’ architecture, their recommendation or discovery systems, and the ways users — including minors — encounter content and interact with one another. For policymakers, this is a practical test of European digital sovereignty: whether the EU can apply a common regulatory structure to services developed largely in the United States without reducing compliance to a formal exercise detached from the way each product actually works.
The unresolved boundary around ChatGPT
The designation of ChatGPT as a VLOSE raises a particularly important legal and technical question. It remains unclear whether OpenAI can separate search-related functions from the broader generative capabilities of ChatGPT for compliance purposes, or whether the Commission will expect an integrated assessment of risks arising from the service as users experience it. That distinction will matter for the company’s compliance roadmap.
A conventional search service may focus on how results are ranked, surfaced and explained. A generative AI system may create or synthesize an answer, rather than simply directing a user to material already available online. Where search and generation meet, questions of transparency, user understanding and systemic risk may be harder to isolate.
OpenAI will also face scrutiny over how it proposes to conduct risk assessments and prepare for independent review within the transition period. The issue is not solely whether the company can produce a compliance document by December, but whether the assessment can meaningfully account for a product that may change through model updates, interface changes and revised search features.
Reddit and Roblox confront different safety pressures
For Reddit, the designation will bring renewed attention to the relationship between platform-scale obligations and its community-based moderation model. The company will need to explain how its systems address risks that emerge across a large and varied network of user communities, rather than in one centrally curated feed. The focus is likely to include the role of recommendation and visibility systems, the effectiveness of moderation arrangements, and the safeguards available where users may encounter harmful or inappropriate material.
A central issue for Reddit will be how the company translates broad systemic-risk duties into measures that work across communities with different rules, cultures and levels of moderation capacity. Roblox faces a distinct pressure point: the safety of minors. As a virtual environment where users can discover experiences and interact socially, the service will be judged not only on individual safety features but on whether its wider design and discovery systems can prevent or reduce systemic harms.
The four-month deadline will therefore test the feasibility of making structural changes at speed. Measures relating to discovery, age-appropriate safeguards, reporting systems or transparency may require adjustments that reach across a large platform ecosystem. Roblox’s response will be closely watched by child-safety advocates as well as by other companies operating social or immersive digital services.
Audit capacity and enforcement loom over the deadline
The transition period also raises a practical question for all three companies: whether suitable independent audit capacity is available on the timetable set by the Commission. The DSA’s heightened obligations are intended to be more than internal promises. They require a level of external scrutiny that can test whether risk assessments and mitigation measures are credible.
That creates a bottleneck. A company may be able to assemble legal, policy and engineering teams rapidly, but an effective audit process depends on access to independent expertise capable of examining complex systems. For generative AI, community platforms and virtual worlds alike, the relevant analysis may span product design, algorithms, moderation, safety and governance.
The Commission’s enforcement powers give the deadline weight, even though the August 31 action is not an immediate sanction. Failure to meet applicable obligations after the transition could expose the companies to formal enforcement, including potentially significant financial penalties under the DSA. By late December, the immediate contest will not be over whether ChatGPT, Reddit and Roblox resemble one another.
It will be over whether Europe’s largest-platform rules can demand comparable accountability while still recognizing that search, social discussion and virtual worlds generate different risks — and require different evidence that those risks are being addressed.
